These booking conditions together with the specific information about your confirmed booking form the basis of your contract with Travel Eco Ltd. registered in The Gambia, registration number 170072432. Please read the booking conditions carefully as they set out your respective rights and obligations.

 How to make a booking

You can make your booking  directly with us or through your local travel agent, who will contact Travel Eco in order to ascertain if the arrangements you require are available. When you make a booking you guarantee that you have the authority to accept and do accept on behalf of your party the terms of these booking conditions. A contract will exist. This contract is made on the terms of these booking conditions, which are governed by the laws of the Gambia and the jurisdiction of the Gambia Courts.  If you had not seen these terms and conditions when you made your booking and you are not happy to proceed now that you have seen them, please return all documentation to us or to your travel agent, within 7 days of the booking having being made and the invoice issued. Your booking will be cancelled and your monies will be returned in full, provided you have not commenced your travel. This clause does not apply if the booking was made within 10 weeks of travel. Please check the details of your Confirmation/Invoice carefully and advise us immediately if anything appears to be incorrect. All monies paid directly to Travel Eco or to your travel agent are held on your behalf until we issue our Confirmation/Invoice.\

Payment Terms

Provided you book at least 4 weeks in advance of our tour departure date, you must pay a deposit of $99 per client per tour (with the exception of day tours where no deposit is required) and the final balance must be paid no later than 14  days before the departure date. If you book within 4 weeks of the tour departure date, you must pay the total price at time of booking. Please note that we do not issue reminders. If you fail to pay by the due date, we reserve the right to cancel your booking and retain your deposit.

 

The price of your tour is fully guaranteed

When you have booked your tour and paid your deposit, the total tour price as shown on your Confirmation/Invoice is fully guaranteed and will NOT be subject to any surcharges, and any subsequent increases are at our expense, excluding any imposed currency fluctuation, fuel surcharge or changes in statutory taxes or charges. However, there will be no change within 30 days of your tour departure date. All prices are subject to change but we will absorb and you will not be charged for any increase equivalent to 2% of the price of your tour cost, you will be charged for the amount over and above that, plus an administration charge of $1 per person together with an amount to cover agent's commission if required. If this means that you have to pay an increase of more than 10% of the price of your tour, you will have the option of cancelling and receiving a full refund of all monies paid, except for any amendment charges. Should you decide to cancel for this reason, you must exercise your right to do so within 14 days of the issue date printed on your final Confirmation/Invoice. Should the price of your tour decrease due to the changes mentioned above, by more than 2% of your tour cost, then any refund due will be paid to you. However, please note that travel arrangements are not always purchased in local currency and some apparent changes have no impact on the price of your tour due to contractual and other protection in place. All prices printed in this brochure are subject to change without notice. The price will be confirmed at the time of booking and of course, you are free to decline the offer of a booking if a price has changed from that published. The prices in this brochure are based on the United States Dollar exchange rate as at August 11 2017.

 

Children

Children 2-15 years of age are entitled to the child price on half day and one day tours as well as on Independent Tours that include overnight accommodation when sharing with at least 1 adult (unless stipulated otherwise). Guided Holidays: children 5-15 years are entitled to the child rate (unless stipulated otherwise).

  Amendments of bookings by you

a) If you amend your booking before a Confirmation/Invoice has been issued no contract has been entered into and there is no charge.

b) If, after a Confirmation/Invoice has been issued, you wish to alter your tour arrangements or to change the departure date we shall do our utmost to make the changes but it may not always be possible. Any request for changes to your touring/travel arrangements must be received by Travel Eco at least 1 week before the departure date of the tour. This will incur an administration fee of $10 per person.

c) If you amend your booking within 1 week of the departure date of your tour, this will be treated as a cancellation and a new booking, incurring cancellation charges as set below in addition to the cost of your new tour booking.

 Cancellation of Bookings by you

You or any member of your party may cancel your booking at any time, providing that the cancellation is advised to Travel Eco in writing by the person who made the initial booking or from your travel agent. Cancellation will be effective from the date Travel Eco receive the written notification. Cancellation fees are as follows:

More than 6 days prior to departure.- No fees

6-1 days-                                            50% of tour price

Less than 24 hours -                           100% of tour price

 

Illness or absenteeism

In the event of your withdrawal from a tour after commencement for reasons of illness, you must obtain a medical certificate in support of your insurance claim. We regret that no refunds can be made for absences from a tour, including but not limited to missed meals or sightseeing. Travel Eco makes no representation or guarantee concerning reimbursements of funds paid by you under any insurance claim.

 

Accommodation

Run of house rooms are used at all hotels featured in this brochure unless otherwise specified. A twin room generally means a room with two single beds but some hotels may offer one double bed or include a bunk bed within the room. We cannot guarantee room configurations in advance. In triple share rooms the third bed may be a 'foldaway', 'sofa bed' or a 'roll away' which can sometimes reduce the amount of available space in a room. No child rate is available when booking a triple room; all guests will be charged the triple rate irrespective of age. Quad share rooms are not available and clients are required to book two rooms. Inter-connecting rooms are available on request and subject to availability. Generally hotel rooms will be available from 3pm and are to be vacated by 10am, irrespective of your arrival or departure time. Should you wish your room to be available prior to 3pm on your day of arrival or available after 10am the day you depart it may be possible to reserve the room for the cost of an additional night. In Barely alternative land accommodation may be substituted.

Airfares

Airfares are not included in the price of your holiday. Where we have specified a particular date, time and flight number, these items could be subject to alteration at the time of booking, so please check with your travel agent. Please note that Travel Eco does not incur any liability for airfares purchased by travel agents or clients via the internet, in the unlikely event that a tour is cancelled. Travel Eco cannot be held responsible for airfare conditions. All such risk, loss and expense must be borne by the travel agent or client.

 

Wifi

Complimentary Wifi service is available in many hotel guest rooms and/or the public areas of most hotels. Complimentary Wifi is also provided on-board most of our touring Mini Buses. Wifi on buses uses a mobile/cellular network and as a result the connection will be slower than regular broadband and at times may not be available in some areas.

 

Tour participation, exclusion and release

Children under five (5) years of age are ineligible to travel on our Guided Tours. Children under eighteen (18) years of age must travel with and be accompanied by an adult. Clients with disabilities are welcome on Travel Eco  tours provided they are accompanied by a companion capable of providing all assistance required, and do not require special assistance form Travel Eco personnel. You must advise Travel Eco at the time of booking if you are affected by any condition, medical or otherwise, that may affect your enjoyment of the tour or its enjoyment by others. Failure to do so may result in the termination of your tour arrangements without any liability on the part of Travel Eco.  Travel Eco reserves the right at its discretion to exclude from a tour or to terminate travel arrangements during the course of the tour without refund of anyone who:

  • • is unable to cope with the requirements of  bus tour travel or who may need or require services or facilities that are not available
  • • fails to comply with the reasonable instructions of  Travel Eco  personnel
  • • engages in illegal, unreasonable, or undesirable behavior or interferes with the enjoyment of or endangers the safety of other tour participants

 

Anyone so excluded will be required to disembark at a safe public location, transport from which will be wholly their responsibility. You agree that Travel Eco is released from all liability for, and you agree not to hold Travel Eco responsible for termination of your travel arrangements in accordance with the previous condition, or any decision made by Travel Eco or by any service provider who refuses to provide you with special accommodation facilities or services that are not available or who refuses to carry you by reason of any disability or medical condition. You agree that our Travel  Eco  Travel Director or Representative may take photographs and film of you while you are on tour and that these may be used in our brochures and/or advertising or publicity material/collateral without obtaining any further consent or payment in respect of such photographs and/or film.

 

Our responsibilities

(a) We accept responsibility for ensuring that your tour arrangements, which you book with us, are supplied as described in our tour brochure/travel documents. If any part of your tour arrangements are not provided as promised due to the fault of our employees, agents or suppliers we will pay you appropriate compensation subject to paragraph (b) below our liability in all cases shall be limited to a maximum of two times the cost of you tour/travel arrangements.

(b) We accept responsibility for death, injury or illness caused by the negligent acts and/or omissions of our employees or agents, our suppliers and sub-contractors, whilst acting within the scope of, or in the course of their employment in the provision of your tour/travel arrangements. We will accordingly pay to you such damages as might have been awarded in such circumstances under  the law of the Gambia.

(c) Excursions or other tours that you may choose to book or pay for whilst you are on holiday are not part of your tour package holiday provided by us. For any excursion or other tour that you book, your contract will be with the operator of the excursion or tour and not with Travel Eco Ltd We are not responsible for the provision of the excursion or tour or for anything that happens during the course of its provision or operation by the operator.

Alteration by Travel Eco to your tour arrangements

It is unlikely that we shall have to make any changes to your tour, as we do plan tour arrangements many weeks in advance. Occasionally changes may be made and we reserve the right to make them at any time as necessary. Most of these changes are of a minor nature and we shall advise you or your travel agent at the earliest possible date. If a major change is necessary, we will inform you or your travel agent as soon as reasonably possible, if the necessary time is available prior to the commencement of your tour. Some tours however, involve travel in 'outback' remote and/or regional areas and Travel Eco reserves the right to alter itineraries or accommodation as necessary due to weather, road and other operational conditions at the time each tour takes place

Vis major

Vis major is a legal term meaning unusual and unforeseen circumstances such as but not limited to war, threat of war, riot, civil strife, industrial dispute, terrorist activity and its consequences, natural or nuclear disaster, fire, adverse weather conditions, epidemic or pandemics, unavoidable technical problems with transport or similar events which are beyond our control. Clients should ensure that they have adequate insurance to cover changes caused by Vis major'.

Condition of carriage

When you travel with a carrier, the conditions of carriage of that carrier apply, some of which may limit liability. This brochure is the responsibility of Travel Eco Tours. It is not issued on behalf of and does not commit any airline whose services are used in the course of the tour. The tours advertised in this brochure are operated by Travel Eco and on behalf of Travel Eco Ltd.

Airport Transfers

Where indicated in this brochure, complimentary arrival and departure shuttle transfers are provided between designated airports and Travel Eco hotels on the scheduled start and end day/date of your tour only. Complimentary transfers are also included with pre/post tour accommodation booked through Travel Eco. All flight information must be provided to Travel Eco at least 3 days prior to your departure date, if this information is not received we are unable to guarantee the transfer/s. These complimentary transfers are dependent on flight arrival/departure times and in certain circumstances, such as early or late arrival/departure, a transfer will not be possible. There is no recompense if Travel Eco is unable to provide either an arrival or departure transfer.

Passports, visa and  health requirements

All requirements should be checked in advance with the relevant Embassy, High Commission, Consulate or government body. We do not accept any responsibility if you cannot travel due to you having not complied with these requirements. You should also take advice on your specific needs regarding vaccinations or health measures you should take due to any stopovers en route to the Gambia or Senegal that you may take.
